Private sector (private businesses and nonprofit organizations) employers in Illinois are governed by the federal Occupational Safety and Health Act (OSH Act). Illinois has a federally approved occupational safety and health regulatory program that governs public sector (government offices and operations) employers.
The state has adopted by reference the federal safety and health standards for hazardous waste operations and emergency response (HAZWOPER) in public sector (state, county, and local government facilities, volunteer fire departments, and school districts) workplaces (56 IL Admin. Code 350.300).
The U.S. Department of Labor/Occupational Safety and Health Administration (OSHA) administers and enforces federal workplace safety and health requirements in private sector workplaces. The Illinois Department of Labor/Division of Safety Inspection and Education administers safety and health rules for public sector workplaces.
